Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") form a binding agreement between you and Gathering Place Properties ("GPP", "we", "us", "our") governing your access to and use of the Homestead mobile application (the "App"). By creating an account or otherwise using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Description of Service

Homestead helps you organize and maintain your properties by letting you catalogue properties and assets, store related documents, set maintenance schedules and reminders, view a maintenance calendar, and use an AI-powered tool to help identify appliances from photos and suggest maintenance tasks.

3. Eligibility & Account Registration

You must be at least 13 years old (or the age of digital consent in your country) to create an account. You agree to provide accurate information when registering and to keep your login credentials confidential. You are responsible for all activity that occurs under your account.

4. Subscriptions, Trials & Billing

Homestead offers a free tier with limited features and an optional Premium subscription ("Premium") with expanded limits and capabilities. Premium is offered on a recurring (monthly or annual) basis and may include a free trial period.

Auto-renewal disclosure. Payment will be charged to your Apple App Store or Google Play account at confirmation of purchase. Subscriptions automatically renew for the same price and duration unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel your subscription at any time in your App Store or Google Play account settings. If you start a free trial and subscribe to Premium before the trial ends, any unused portion of the free trial will be forfeited.

Prices, trial lengths, and promotional offers are displayed in the App and may vary by region and over time. Except where required by law, fees are non-refundable; refund requests are handled by Apple or Google according to their respective policies.

5. User Content & License

"User Content" means properties, assets, photos, documents, notes, and any other material you add to the App. You retain ownership of your User Content. By uploading User Content, you grant GPP a limited, non-exclusive, worldwide license to host, store, process, and display that content solely for the purpose of operating and providing the App to you. We do not sell your User Content or use it to train third-party advertising profiles.

6. AI-Generated Content Disclaimer

For informational purposes only. The AI Asset Scan feature analyzes photos you provide to suggest a brand, model, serial number, and maintenance tasks for an appliance. These suggestions are generated automatically and may be inaccurate, incomplete, or out of date. They do not constitute professional, safety, electrical, plumbing, HVAC, or other technical advice. Always verify information against the manufacturer's documentation and consult a qualified professional before performing maintenance, repairs, or safety-related work.

7. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable law or regulation;
  • Upload content that infringes the rights of others or that you do not have the right to share;
  • Attempt to gain unauthorized access to the App, other accounts, or our systems;
  • Reverse-engineer, decompile, or interfere with the proper functioning of the App;
  • Use automated means to scrape, extract, or overload the App's infrastructure.

8. Intellectual Property

The App, including its design, branding, text, graphics, and underlying software, is owned by GPP and protected by intellectual property laws. Except for the limited license to use the App as intended, these Terms do not grant you any rights to GPP's trademarks, logos, or other brand assets.

9. Termination & Account Deletion

You may stop using the App at any time and may permanently delete your account and associated data from within the App. See Account Deletion for details and instructions. We may suspend or terminate your access if you violate these Terms or if required to do so by law.

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that AI-generated suggestions will be accurate.

11. Limitation of Liability

To the maximum extent permitted by law, GPP shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or property, arising from your use of or inability to use the App, including reliance on AI-generated maintenance suggestions, even if advised of the possibility of such damages.

12. Governing Law

These Terms are governed by the laws of the United States, without regard to its conflict-of-law principles, except to the extent that mandatory consumer protection laws of your country of residence apply.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page and, for material changes, provide notice within the App. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
